If you have been charged with a second, third, or fourth DUI, or a DUI with aggravating circumstances, you are probably aware that you are facing increased penalties—possibly even a mandatory jail sentence—if you are convicted again. Under Florida Statute 316.193, these are the potential jail sentences for each successive DUI conviction:

First Conviction: Not more than six months. With a BAC of .15 or higher or if there's a minor in the vehicle, not more than nine months.

Second Conviction: Not more than nine months. With a BAC of .15 or higher or with a minor in the vehicle, not more than twelve months. If the second conviction is within five years of the first, mandatory imprisonment of at least ten days. At least forty-eight hours of confinement must be consecutive.

Third Conviction: If the third conviction is within ten years, mandatory imprisonment of at least thirty days. At least forty-eight hours of confinement must be consecutive. If the third conviction is more than ten years after the first, imprisonment for not more than twelve months.

Fourth or Subsequent Conviction: Not more than five years or as provided in s.775.084, Florida Statutes, as habitual/violent offender.

All convictions also carry fines, driver's license suspension or revocation, mandatory courses, vehicle impoundment, and a criminal record. The court may also order an ignition interlock device to be placed on your vehicle at your own expense.
